A power of attorney is someone who you legally assign to act on your behalf and take care of your financial affairs and medical care in the event that you should lack the capacity to do so. When selecting a power of attorney, you should take this decision seriously as they will have enormous responsibility and power over your affairs. Choosing the right power of attorney can be stressful, but if you do your due diligence in the selection, you will have done the right thing to protect yourself and your affairs during a difficult time.

Here are three things to consider when choosing a power of attorney:

  1. Trust- Trusting your power of attorney is a big thing because this is the person who will uphold your wishes when the time comes, and you need to know that the person you select understands your desires and is able to fulfil your wishes. Assigning power of attorney to someone you trust will give you peace of mind that in the event of incapacitation, you have someone who you trust handling your affairs.
  2. Geography- Selecting a power of attorney requires geographic considerations as well so that if a situation arises, they will be able to show up and handle your affairs. Likewise, having someone outside of the country as your power of attorney is not helpful if you require immediate support.
  3. Relationship - You should be wary of assigning power of attorney to someone in your family as making these decisions on your behalf can be an emotional burden on your loved ones. It’s recommended that you are not closely related to your power of attorney so that they are able to remain neutral when handling your affairs.
