Beyond Guardianship: Steps for Protecting Your Children’s Future

As a parent, your greatest and most precious asset is undoubtedly your children. Yet, you may not have taken these important steps to protect your children, especially in the unfortunate event that you become unable to care for them.

  • Determine first responders—While you may have already established guardianship for your children, who will take over care of them on a short-term basis if an unexpected accident takes place? Name someone as a first responder (this can be a family friend, neighbor, or relative who lives close by) who can take care of your children until formal arrangements can be made.
  • Define guardianship for long-term care—Even though your best friend or sister may be the best option for guardianship right now, is this person realistically going to be able to care for your children on a long-term basis? Consider this as you choose a guardian and communicate these wishes to whoever you select.
  • Plan even if you are unsure—As with most things in life, any plan is better than no plan at all, even if it isn’t perfect. Do not let your reluctance to establish guardianship result in a plan that you would not want.
  • Take steps to prevent probate—If there is a chance your assets will go through the court process following your death, take precautionary measures and put them in a living trust. Probate can be expensive, time-consuming, and inconvenient, which can make it difficult for your children to have access to the financial resources they need in the meantime.
