It can feel morbid to plan for our eventual demise, but estate planning is a responsibility you have to your family and dependents. Estate planning is the only way to protect your loved ones and to ensure that when your time comes, you have eliminated their burden.

Here are 3 things you need to consider when estate planning:

  1. Understanding Probate - Without a will that clearly states your beneficiaries and breakdown of your assets, in the event of your death the court will settle your estate for you. That’s why avoiding writing a will can only hurt your family, with the expense associated with settling your estate in court, and the stress on your family in fighting over your asserts.
  2. Assign Beneficiaries to All Assets - A valid will does not necessarily offset the probate process, however the courts and executor are bound by your will to fulfil your wishes. This includes the physical asset distribution and asset allocation for your beneficiaries. With a will, you have the opportunity to include an inventory of all valuable possessions (including properties, vehicles, jewelry, etc.) and assigning beneficiaries for everything included in your will. This clarity for asset distribution eliminates any painful squabbles between your family who will respect your wishes as stated in your will.
  3. Power of Attorney - Selecting a power of attorney is another precaution you should take when estate planning. A power of attorney is legally bound to represent your financial interests in the event of your death (Financial POA) and can also make important decisions for your care in the event of an illness or incapacitation (Medical POA).
